Product photography and written descriptions are a large part of what an online knitwear shop actually produces. A measurement table and a photograph that shows a stitch honestly take real work, which is why we protect ours and why we take a complaint about someone else’s seriously.

Ownership of Site Content

Everything published on https://acaamg.com, including product photographs, written descriptions, measurement tables, blog articles, page layout, and the Acaamg name and logo, is owned by us or used under license. United States and international copyright and trademark law applies to all of it.

What You May Do

You may view our pages, print them for your own reference, and share links to them. Quoting a short passage with attribution and a link back is fine. None of that needs to be cleared with us first.

What Needs Permission

Republishing our photographs or descriptions, using our content in another shop’s listings, using our name or logo in a way that suggests an endorsement, or reproducing the site systematically all require written permission. Ask us. Permission is granted more often than people expect.

Respect for Third-Party Rights

We do not list items bearing marks or designs we are not entitled to sell, and we do not use another brand’s name in a product title, a description, or a search term to attract traffic. If you believe we have done so by mistake, tell us and it will be corrected.

Filing a DMCA Notice

If you own a copyright and believe material on our site infringes it, send a written notice to [email protected]. Under 17 U.S.C. 512(c)(3) the notice must include all six of the following:

  1. A physical or electronic signature of the copyright owner, or a person authorized to act for them
  2. Identification of the copyrighted work you say has been infringed
  3. Identification of the material on our site you say is infringing, with enough detail for us to locate it, such as a full page address
  4. Your contact details, including a mailing address and an email address
  5. A statement that you believe in good faith that the use is not authorized by the copyright owner, its agent, or the law
  6. A statement that the information in the notice is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner

What Happens After a Notice

We acknowledge a complete notice and remove or disable the material identified in it, ordinarily within a few business days. The person who posted it is notified and given a copy of the notice, along with an explanation of the counter-notice route below.

Filing a Counter-Notice

If your material was removed and you believe that was a mistake or a misidentification, you may send a counter-notice to the same address. Under 17 U.S.C. 512(g)(3) it must include all six of the following:

  1. Your physical or electronic signature
  2. Identification of the material that was removed and where it appeared before removal
  3. A statement under penalty of perjury that you believe in good faith the material was removed as a result of mistake or misidentification
  4. Your name, mailing address, and the contact details required by the statute
  5. A statement consenting to the jurisdiction of the federal court for the district where you live, or where we are located if you live outside the United States
  6. A statement that you will accept service of process from the party who filed the original notice

Where a valid counter-notice is received, the material may be restored in 10 to 14 business days unless the original complainant files a court action first.

Repeat Infringers

Accounts and users who repeatedly infringe the rights of others have their access to the site terminated, in line with the DMCA safe harbor requirements.

Misrepresentation

Section 512(f) makes a person who knowingly misrepresents that material is infringing, or that it was removed by mistake, liable for damages and legal costs. Please be certain of your claim before filing.
